This section describes the prosecution outcome categories used in the prosecuted charges and prosecuted people tables. Outcome refers to the final disposition of charges finalised in the High Court and District Court.
Prosecution outcome categories are:
- Convicted – only charges finalised in the District or High Court can result in the offender being convicted.
- Diversion, S106 – these charges are not recorded as convictions, and includes charges where:
- the police offer diversion
- a discharge without conviction (under section 106 of the Sentencing Act 2002 or section 19 of the Criminal Justice Act 1985, where after the offender is found guilty or pleads guilty, the court considers the consequence of a conviction for the defendant outweighs the seriousness of the offence committed).
- Not proved – includes charges acquitted; dismissed; discharged; not proceeded with; pardoned; struck out; and withdrawn.
- Other – covers charges where there was a stay of proceedings; charges where the person was found unfit to stand trial; charges where the person was acquitted on account of insanity and an order was made; and other remaining prosecution outcomes.
